PerfectTrAIner – Terms & Conditions

Welcome to PerfectTrAIner. By downloading, accessing, or using the PerfectTrAIner mobile application (“App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not use the App.


1. Acceptance of Terms

By using PerfectTrAIner, you acknowledge that:

  • You have read, understood, and agree to these Terms.

  • You are legally capable of entering into this agreement.

  • You agree to comply with all applicable laws and regulations.


2. Minimum Age Requirement

You must be at least 16 years old (or the minimum legal age in your region) to use PerfectTrAIner.
If you are under 18, you may use the App only with the consent of a parent or legal guardian.


3. Description of Service

PerfectTrAIner is an AI-powered fitness and nutrition app that provides:

  • Personalized workout suggestions

  • Nutrition tracking and meal recommendations

  • Progress analytics and insights

  • Fitness tips, guidance, and educational content

These features may use AI models including OpenAI and Google Gemini.

PerfectTrAIner does not provide medical, health, or nutrition advice.
All AI-generated and app-generated content is for informational and entertainment purposes only.


4. Health, Safety & AI Disclaimer

By using PerfectTrAIner, you acknowledge and agree that:

  • The App does not diagnose, treat, cure, or prevent any medical condition.

  • The App is not a medical device and cannot replace professional medical advice.

  • All AI-generated workout, fitness, or nutritional suggestions are non-professional recommendations and may contain errors or be unsuitable for you.

  • You should always consult a licensed physician, healthcare provider, certified trainer, or registered dietitian before starting any new exercise or nutrition plan.

  • You are solely responsible for evaluating your own physical condition and determining what exercises or nutrition changes are safe for you.

  • Physical activity carries inherent risks, and you voluntarily assume all risks associated with using the App.

PerfectTrAIner is not responsible for:

  • Injuries

  • Health problems

  • Adverse reactions

  • Damages resulting from following AI recommendations or using the App

Individual results will vary, and no results are guaranteed.


5. Third-Party AI Services

PerfectTrAIner uses third-party AI systems such as OpenAI and Google Gemini.
By using the App, you acknowledge that:

  • Your data may be processed by these third parties solely to provide AI features.

  • These third parties have their own terms and privacy policies.

  • AI-generated responses may be inaccurate, incomplete, outdated, or inappropriate.

  • PerfectTrAIner does not control or guarantee the accuracy of AI outputs.


6. User Responsibilities

You agree to:

  • Provide accurate and truthful information within the App.

  • Use the App safely, responsibly, and within your physical ability.

  • Not rely solely on AI recommendations for health decisions.

  • Not share your account with others.

  • Not misuse or attempt to manipulate the AI system.

  • Use the App only for lawful purposes.


7. User-Submitted Content

Users may upload or enter content such as:

  • Notes

  • Food logs

  • Workout information

  • Personal data

You retain ownership of the content you submit.
However, by submitting content, you grant PerfectTrAIner a non-exclusive, worldwide, royalty-free license to store, process, display, and use your content as necessary to operate the App.

You agree not to submit content that is:

  • Illegal

  • Offensive

  • Harmful

  • Copyright-infringing

  • In violation of others’ privacy


8. Subscriptions & Billing

Some features of PerfectTrAIner may require a paid subscription.

  • Payments, refunds, and billing are handled by Apple App Store or Google Play, not PerfectTrAIner.

  • Subscriptions may automatically renew unless canceled.

  • You may cancel your subscription through your device account settings.

PerfectTrAIner does not issue refunds directly.


9. Intellectual Property

All content, branding, software, features, and functionality within PerfectTrAIner are owned by ABX Tech Corp and protected under applicable copyright, trademark, and IP laws.

You may not:

  • Copy, modify, or distribute the App

  • Reverse engineer the App

  • Use our trademarks without permission


10. Prohibited Uses

You may not use the App to:

  • Break the law or encourage illegal activity

  • Harass, harm, or exploit others

  • Upload malicious software

  • Attempt to gain unauthorized access to systems

  • Misuse AI features or automate interactions in unintended ways


11. Limitation of Liability

To the fullest extent permitted by law:

PerfectTrAIner and its creators are not liable for any direct, indirect, incidental, consequential, or special damages, including injuries, losses, or health issues resulting from:

  • Following AI recommendations

  • Using or misusing the App

  • Technical issues, bugs, or outages

  • Third-party service failures

The App is provided “as is” without any warranties, express or implied.


12. Termination

We may suspend or terminate your access if you:

  • Violate these Terms

  • Misuse the App

  • Engage in fraudulent or abusive behavior

You may stop using the App at any time.


13. Changes to Terms

We may update these Terms at any time.
Continued use of the App after updates constitutes acceptance of the revised Terms.


14. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.
